The construction industry plans to make the procedures for analyzing prices for construction products more practical and reduce the administrative burden on customers. The draft amendments to the Cabinet of Ministers Resolution No. 1512 with the relevant proposals have been sent for approval to the central executive authorities, associations and regional administrations.
This was discussed during a meeting on the reform of pricing in construction and its practical implementation during a meeting at the Ministry of Reconstruction, Infrastructure and Transport of Ukraine with representatives of the anti-corruption and expert environment, international partners, writes РrofBuild with reference to information from the Ministry of Reconstruction.
The focus of the meeting is to assess the proposed changes with representatives of the anti-corruption environment to maintain a balance of control over the use of public funds.
“The reform of pricing in construction is fundamental for the entire reconstruction system. Our task is to find a balance between maximum transparency in the use of public funds and the rapid implementation of projects that are critically important for the country today. The reform should not create additional barriers, but on the contrary - provide customers with understandable digital price analysis tools, protect them from subjective claims of regulatory authorities and guarantee transparent and fair operating rules for businesses,” emphasized Deputy Minister of Reconstruction, Infrastructure and Transport of Ukraine Natalia Kozlovska.
A separate topic of the meeting was the decisions developed by the Ministry together with the State Audit Service based on the results of a series of consultations with regional military administrations, local governments, the Association of Ukrainian Cities, the Association of United Territorial Communities and the expert community.
In particular, it is proposed to:
- set a threshold of UAH 1.5 million, above which price analysis will be carried out according to the procedure specified in Resolution No. 1512;
- for objects of lower value, customers will independently determine the procedure for price analysis using internal documents, which will avoid unnecessary bureaucracy for schools, hospitals and other social sphere objects;
- it is planned to significantly simplify the preparation of reports due to a differentiated approach to the analysis of items in the estimate depending on their impact on the total cost of construction.
Thus, price-forming materials (60% of the cost) will be checked according to the full procedure, for less valuable resources (35% of the cost) a simplified analysis is provided, and for low-value materials the requirements for confirming information sources will be minimized. According to expert estimates, this will make it possible to reduce the time for generating a report by up to 80%.
A separate block of changes concerns the regulation of interaction with suppliers. It is proposed to establish a maximum waiting period for a response to a request for prices - five working days. If a response is not received, the fact of sending a request will be recorded in the UEDESSB and will be considered sufficient confirmation of the validity of the absence of competitive offers. In addition, it is proposed to equate official price lists of manufacturers and data from the UEDESSB Price Base with commercial offers.
The Ministry of Development emphasizes that the draft amendments also clearly delimit the responsibilities of the participants in the process. The reliability of information on the status of the supplier, for example, an official distributor, will be borne by the person submitting the price offer, while customers and estimators will not be responsible for checking this information and will not be required to request additional supporting documents.
For manufacturers of construction products, it is proposed to establish that the placement of prices in the UDESSB Database is exclusively indicative and does not create obligations to supply or sell products at published prices. It also provides for free entry of information into the system via API, which should stimulate more active filling of the Price Database.
In addition, the amendments propose to clearly define the functions of the customer and contractor at different stages of project implementation, as well as to provide transitional provisions that will make it impossible to stop construction projects that have already begun or to undergo a re-examination only due to the introduction of new requirements for electronic reports. This will allow the implementation of existing projects to continue without delays, while ensuring the gradual implementation of new pricing mechanisms.
